1. Definitions

• "User", "You": Any individual or entity accessing the Service.
• "HitzDistro", "We", "Us": The platform operator and service provider.
• "Content": Audio recordings, artwork, metadata, and other materials uploaded by you.
• "DSPs": Digital Service Providers (e.g., Spotify, Apple Music, TikTok) where we distribute your Content.

2. Account Registration and Security

To use most features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the security of your password and accept all risks of unauthorized access to your account.
• Notify us immediately if you discover or suspect any security breaches.

HitzDistro is not liable for any loss or damage arising from your failure to protect your account credentials.

3. Acceptable Use Policy

You agree not to use the Service to:

• Upload Content that infringes on any patent, trademark, trade secret, copyright, or other proprietary right of any party.
• Upload Content that is hate speech, threatening, sexually explicit, or incites violence.
• Distribute malware, viruses, or any other harmful computer code.
• Engage in "phishing" or collecting data from other users without their consent.
• Interfere with or disrupt the integrity or performance of the Service.

Violation of this policy may result in immediate account termination and legal action.

4. Third-Party Services (DSPs)

Our Service enables you to distribute Content to third-party DSPs. You acknowledge that:

• HitzDistro has no control over the policies, operations, or terms of DSPs.
• DSPs may reject or remove your Content at their sole discretion.
• Your relationship with DSPs is subject to their respective terms of service.

5. Intellectual Property

Your Rights: You retain full ownership of your Content. We do not claim ownership rights.

Our Rights: The HitzDistro interface, logo, code, and design are the exclusive property of HitzDistro. You may not copy or reverse-engineer any part of the Service.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HITZDISTRO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

7. Indemnification

You agree to defend, indemnify, and hold harmless HitzDistro and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service or your violation of these General Terms.

8. Dispute Resolution

Binding Arbitration: Any dispute arising from these General Terms shall be resolved through binding arbitration, rather than in court.

Class Action Waiver: YOU AND HITZDISTRO AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION.

9. Changes to Terms

We may modify these General Terms at any time. If we do so, we will post the modified terms on this page and update the "Last Updated" date. Your continued use of the Service after any modification constitutes your acceptance of the new terms.
